Publicly Available Data
You agree that the information you choose to share with us through the Service about you was information you authorized third party internet services providers to share through the internet with the public about you; was lawfully made available by you to a federal, state, or local agency; may be lawfully found in federal, state, or local government records; or was made available to the general public by you before you shared it through the Service.
What Information About You Do We Collect?
For the purpose of carrying on our business and administering our Service, we may collect, use, store and transfer different categories of personal data which we have grouped together as follows:
We may collect personal identifiers including your name, alias, postal or mailing address, email address, and telephone number.
We may collect geolocation information including your internet protocol (IP) and the address, city, county, and/or state where you are located.
When you register for a Membership or otherwise purchase a product or service through our Service, we collect details about payments made to and from you. This includes bank account number, credit card number, debit card number, and other financial account information.
We may collect technical data including your login data, browser type and version, time zone setting and location, operating system, and other technology on the device used to access the Service.
We may collect your username and password, purchases or orders, purchase or order history, product interaction, your browsing history, interests, preferences, feedback, interactions with customer support, related products and services subscribed to, and other profile data.
We may collect usage data including crash data, performance data, and information about how you use the Service.
What Sources Do We Use to Collect Information?
You may affirmatively provide us with certain personally identifiable information (such as your name, email address, phone number, postal address, photos, and videos) and any personal information that you voluntarily provide to us when using the Service.
Information Collected by “Cookies”:
Our servers automatically record certain information that your browser sends whenever you access the Service. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser.
Information Collected by “Clear GIFs”:
We may employ “clear GIFs” (a.k.a. Web Beacons), which are used to track usage patterns anonymously (i.e., in a non-personally-identifiable manner). In addition, we may also use clear GIFs in HTML-based emails sent to users to track which emails are opened by recipients.
Third Parties or Publicly Available Sources:
We may receive personal data about you from various third parties and publicly available sources.
Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with a Membership in exchange for payment). In this case, we may have to cancel the contract you have with us, but we will notify you if this is the case at that time.
How Do We Do Use Your Personal Information?
We may use the personal information you choose to submit through the Service to communicate with you about our services. When we collect this information, we may store it in our computer systems. Do not submit any information via the Service that you do not want us to store or use. If you do not want to submit information through the Service, call us instead.
We have set out below a description of all the ways we may use your personal information.
Send you commercial or marketing messages
Respond to your questions or concerns
Comply with a legal obligation
Provide, maintain, and improve our Service
Notify you of major Service changes
Perform a contract with you
Identify and repair errors that impair existing intended functionality of the Service
Protect against malicious or illegal activity and prosecute those responsible
Improve the Services for all visitors
We use aggregated information (such as anonymous user usage data, cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of the Service and to create new features, promotions, functionality, and services by storing, tracking, and analyzing user preferences and trends. In addition, we may use “cookies,” clear gifs and log file information to deliver content (which may include third party advertisements) specific to your interests, and remember information so that you will not have to re-enter it each time you visit the Service.
You can, of course, disable cookies on your computer by indicating this in the preferences or options menus in your browser. However, it is possible that some parts of the Service will not operate correctly if you disable cookies. The Service may not support your browser software’s Do Not Track setting or feature. Some Internet browsers include the ability to transmit Do Not Track signals that give you control over the collection and use of web browsing information. Since there are no uniform standards for such signals, the Service does not process or respond to such signals. You should consult with your browser’s provider/manufacturer if you have any questions regarding disabling cookies.
Will We Sell Or Share Personal Information with Others?
We will not share or sell your personal information with other, third-party companies for their commercial or marketing use without your consent or except as part of a specific program or feature for which you have the ability to opt-in or opt-out.
We may share non-personal information (such as anonymous or deidentified User usage data, referring / exit pages and URLs, platform types, number of clicks, etc.) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the Service.
Third Party Advertisers
Is My Information Secure?
We have implemented reasonable security measures, including limiting the number of people that have access to our database servers and installing electronic security systems, to protect personally identifiable information collected on the Service against loss, misuse or alteration. In addition, your account information is protected by a password for your privacy and security. It is important that you protect against unauthorized access to your password and to your computer by logging off once you have finished using a shared computer. Moreover, despite the precautions described above, we cannot and do not guarantee that the individual user information you have transmitted will not be intercepted by others and/or decrypted or accidentally disclosed, and we accept no liability for any unintentional disclosure. Accordingly, we cannot ensure or warrant the security of any information that you transmit to us, so you do so at your own risk.
In the Event of Merger, Sale, or Bankruptcy
In the event that we are acquired by or merged with a third party entity, we reserve the right to transfer or assign the information we have collected from users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your personal information is treated, transferred, or used.
Request to Delete
We will, up to 2 times in a 12-month period, honor a request that we delete personal information that we collected from you, subject to certain exceptions (such as where an applicable law requires us to retain the data). You can submit a deletion request by e-mailing us at firstname.lastname@example.org. In the app, users can request that their account be deleted by going to My Account, opening User Info, clicking on Edit, pressing Delete Account. When you submit a deletion request, we will ask you to provide some information in order to verify your identity and respond to your request. Specifically, we will ask you to verify information that can be used to link your identity to particular records in our possession or to a user account, which depends on the nature of your relationship and interaction with us. We will endeavor to respond to and comply with your deletion request within 45 days.
We do not target, market to, or offer the Service to children under the age 13 who are living anywhere in the world. We do not collect or maintain information on our Service from those we actually know are under the age of 18. We request that all visitors to our Website who are under 18 not disclose or provide any personal information. If we discover that we have collected personal information about a person under the age of 18, we will take appropriate steps to delete that person’s personal information from our records.
Special Note to International Users
If you submit your personal information through the Service, we may send you emails. Additionally, you may opt-in through the Service to receive our newsletter via email. If you receive an email from us that you did not want to receive or if you want us to stop sending you emails after you receive one from us, follow the unsubscribe instructions in the email. We will use reasonable and appropriate measures to honor your request. If you unsubscribe from emails, we may still communicate with you as necessary for reasons including, but not limited to, verifying your email, providing you with goods and/or services, performing a contract with you, resetting your login credentials, responding to you, and notifying you of changes to the Service.
